1. About these Terms

These Website Terms of Use ("Terms of Use") govern your access to and use of bluberripress.com (the "Website"), operated by BluBerri Press Content House (Pty) Ltd (Registration No. 2026/169849/07), trading as BluBerri Press ("BluBerri", "we", "us"). By accessing or using the Website you agree to these Terms of Use. If you do not agree, please do not use the Website.

These Terms of Use govern general Website use only. If you subscribe to the BluBerri service, your subscription is governed by the Service Agreement (bluberripress.com/terms), which prevails over these Terms of Use for paying subscribers. Our Privacy Policy (bluberripress.com/privacy) governs how we handle personal information, and our Refund & Cancellation Policy (bluberripress.com/refunds) governs billing.

2. Company information (ECTA)

The company information required by section 43 of the Electronic Communications and Transactions Act, 25 of 2002 is published on our contact page (bluberripress.com/contact), including our registered name, registration number, registered address (24 Gregory Avenue, Melrose North, Johannesburg, Gauteng, 2196), and contact details.

3. Use of the Website

You may use the Website only for lawful purposes. You must not: attempt to gain unauthorised access to any part of the Website, the Dashboard, or our systems; interfere with the Website's operation, including by introducing malicious code or attempting denial of service; scrape, harvest, or bulk-download content or data from the Website without our written consent; misrepresent your identity or affiliation; or use the Website to infringe anyone's rights, including privacy and intellectual property rights.

4. The /try demo

The /try demo lets you generate a sample content piece. It is provided free, for evaluation only, "as is", and may be changed, limited, or withdrawn at any time. When you use /try you must only upload images you have the right to use. Personal information submitted through /try is handled as described in the Privacy Policy and the notice on the /try page: your photo and details are used to generate your sample; your photo is not stored by BluBerri and your sample result is deleted within 30 days; marketing follow-up happens only if you separately opt in. Demo outputs are provided for evaluation; commercial use of demo outputs is at your own risk.

5. Intellectual property

The Website and its content — text, graphics, logos, page designs, and underlying software, including BluBerri's proprietary systems — are owned by or licensed to BluBerri and protected by law. You may view and print Website content for your own evaluation and internal business purposes. You may not otherwise reproduce, distribute, or create derivative works from Website content without our written consent. Content delivered to paying clients is governed by the Service Agreement, not this clause. "BluBerri Press" and associated branding may not be used without our prior written consent.

6. Third-party links

The Website may link to third-party sites (for example PayFast at checkout). We are not responsible for third-party sites, their content, or their privacy practices.

7. Disclaimers and liability

The Website is provided "as is" and "as available". To the maximum extent permitted by law — and without limiting any right you may have under the Consumer Protection Act, 68 of 2008 — BluBerri does not warrant that the Website will be uninterrupted or error-free, and is not liable for indirect, incidental, or consequential loss arising from Website use. Nothing in these Terms of Use excludes liability that cannot lawfully be excluded.

8. Privacy

Personal information collected through the Website is processed in accordance with POPIA and our Privacy Policy (bluberripress.com/privacy). Our PAIA Manual is at bluberripress.com/paia.

9. Changes to these Terms of Use

We may update these Terms of Use from time to time. The current version, with its version number and effective date, is always at bluberripress.com/terms-of-use. Continued use of the Website after changes take effect constitutes acceptance.

10. General

These Terms of Use are governed by the laws of the Republic of South Africa. If any provision is unenforceable, the rest remain in force. Failure to enforce a right is not a waiver.
